Umum sudah mengetahui Samsung telah disaman oleh Apple kerana melanggar hak cipta terpeliharanya dengan jumlah yang sangat mengejutkan sebanyak USD 1 billion untuk pampasan kerana kesalahan tersebut. Anehnya kesalahan hak cipta tersebut hanyalah reka bentuk yang seakan sama seperti produk Iphone dan Ipad. Erti kata lain, produk atau gadet tidak boleh mempunyai rekaan berbentuk empat segi sama seperti produk Apple yang lain. #BoycottApple merasakan, ianya tidak adil dan keterlaluan kerana reka bentuk terlalu ‘common’ atau biasa kelihatan. Bayangkan jika kuih karipap dipatenkan rupa bentuknya. Pastinya ianya tidak logik kerana reka bentuk tersebut bukanlah unik. Mungkin contoh yang diberikan oleh saya ini tidak menggambarkan isu sebenar mengapa Apple mengambil tindakan sedemikian. Sebelum ini, terdapat kes yang sama seperti isu hak cipta terpelihara ini antara IBM dan Microsoft.

Samsung should review IBM vs Microsoft 20 years ago. IBM sued Microsoft because they pirated the idea of placing a menu (File Edit ….) across the top of the screen for their Excel spreadsheet from IBM’s Lotus 1-2-3 spreadsheet.

The court found that even though IBM did own the intellectual property and Microsoft did infringe IBM’s rights, IBM lost their case BECAUSE the idea of having a menu across the top of the screen, even though IBM invented it, had become too common.

Too bad lawyers and judges these days don’t know from whence we have come. Allowing Apple to prevail in a lawsuit against #Samsung because they used a “rectangular screen with rounded corners” or “swipe to open” is a clear violation of established precedence. Sumber

Kini Google pula menyaman Apple. Bukan untuk membela rakan kamcingnya, Samsung tetapi atas sebab pelanggaran hak cipta Motorola Mobility yang telah dibeli oleh Google. Jika difikirkan, produk Samsung kebanyakkannya menggunakan perisian Android. Apple telah mendapatkan perintah mahkamah untuk menghalang produk Samsung dijual di Amerika. Secara tidak langsung penguasaan Android akan terjejas dengan tindakan tersebut. Pastinya kes saman-menyaman ini akan berlarutan dan perkembangan gadjet baru mungkin sedikit terjejas.


Motorola has already sued Apple over similar standards based patents. Now the new suit is over non=essential patents. As Anthony says, this is significantly different:

The Wall Street Journal reports that Google/Motorola is alleging that Apple has infringed on seven of its patents, none of which are standard-essential. This distinction is important. As FOSS Patents explains, “The announcement comes six days before the target date for a final decision on the ITC investigation of Motorola’s first ITC complaint against Apple (July 23). A preliminary ruling by an ITC judge held Apple to infringe only one of Motorola’s asserted patents, which is a standard-essential one that raises competition issues and is, therefore, less likely to result in an actual import ban.”

If a patent is deemed to be “essential” to an “industry standard,” then, as Tim Cook told Walt Mossberg, there is just “an economic argument” about how much licensees have to pay the patent holder, but courts rarely grant injunctions for standard-essential patents. Sumber
